1. About These Terms
These Terms and Conditions govern the use of the website at phuengco.info and set out the basis on which Phueng Counsel provides legal services to clients. By using our website or engaging our services, you agree to these Terms.
Phueng Counsel is a legal practice registered in Thailand and operating under the Lawyers Council of Thailand. Our principal place of business is at 145/4 Ratchaphruek Road, Mueang Udon Thani, Udon Thani 41000, Thailand.
If you have questions about these Terms, please contact us at [email protected].
2. Use of This Website
This website is provided for informational purposes. Nothing on this website constitutes legal advice, creates a client relationship, or should be relied upon as a substitute for professional legal counsel specific to your circumstances.
You may use this website for lawful purposes only. You agree not to:
- Use the website in any way that is unlawful, misleading, or harmful to others.
- Attempt to gain unauthorised access to any part of the website or our systems.
- Submit false or misleading information through our contact forms.
- Copy, reproduce, or redistribute any content from this website without our prior written consent.
We reserve the right to restrict or terminate access to the website at our discretion, without notice.
3. Legal Services Engagement
A formal client relationship is established only when both parties have agreed in writing to the terms of an engagement. This agreement takes the form of an engagement letter issued by Phueng Counsel, which sets out the scope of the work, the agreed professional fee, and the expected timeline.
No legal services engagement is created by:
- Submitting a contact form enquiry on our website.
- Participating in an introductory conversation or initial consultation.
- Sending an email or making a telephone call to our office.
We reserve the right to decline to act for any prospective client, including where a conflict of interest exists or where we determine that we are not in a position to provide the service requested.
4. Professional Fees
Our professional fees are as set out in the engagement letter agreed with you before any work commences. For the services listed on our website, indicative fees are stated as a guide only — the fee applicable to your engagement will be confirmed in writing.
The following apply to all engagements:
- Fees are stated in Thai Baht (฿) unless otherwise agreed.
- Third-party costs — such as registration fees, government charges, and fees payable to external counsel — are in addition to our professional fees and will be disclosed before they are incurred.
- Invoices are payable within the timeframe specified in the engagement letter.
- Where work is halted or an engagement is terminated by the client prior to completion, we reserve the right to invoice for work completed to that point on a time and disbursement basis.
5. Confidentiality
We treat all information shared with us in the course of an engagement as confidential. We will not disclose client information to third parties except as set out in our Privacy Policy, or as required by law or professional regulation.
Our confidentiality obligations continue after the conclusion of an engagement. Former clients may request that we destroy or return documents held on their file, subject to our professional record-keeping obligations.
6. Scope of Our Advice
Phueng Counsel provides legal services under Thai law. Where an engagement involves assets, beneficiaries, or legal considerations in other jurisdictions, we will identify this at the outset and, where appropriate, coordinate with qualified legal practitioners in those jurisdictions.
Our advice is provided specifically for the matter described in the engagement letter. It should not be applied to other situations or relied upon by parties who are not named in the engagement without our prior written agreement.
The law applicable to inheritance, trusts, and estate matters may change. Our advice reflects the law as it stands at the time of the engagement. We do not accept responsibility for changes in law occurring after the completion of an engagement unless we have been specifically engaged to advise on those changes.
7. Limitation of Liability
To the extent permitted by Thai law and our professional standards, our liability for any claim arising from or related to a legal services engagement is limited to the professional fee paid for that engagement.
We do not accept liability for:
- Loss arising from the client's failure to provide accurate or complete information.
- Loss arising from changes in law or official interpretation after the date of our advice.
- Consequential or indirect losses of any kind.
- The actions or omissions of third-party practitioners engaged as part of a cross-border matter.
Nothing in these Terms limits our liability for fraud, gross negligence, or any other matter that may not lawfully be excluded.
8. Termination of Engagement
Either party may terminate an engagement by providing written notice to the other. On termination:
- We will invoice for work completed to the date of termination.
- We will return any documents provided to us by the client, unless we are required to retain them by law.
- We will retain copies of our own working files in accordance with our professional obligations.
We reserve the right to terminate an engagement where the client has provided misleading information, where a conflict of interest arises, or where continued engagement would place us in breach of our professional obligations.
9. Complaints
We are committed to providing services of a high standard. If you are dissatisfied with any aspect of our service, we ask that you contact us in the first instance so that we may attempt to resolve the matter.
Complaints should be directed to: [email protected] or by post to our office address. We will acknowledge a written complaint within five working days and provide a substantive response within 30 days.
If a complaint cannot be resolved to your satisfaction, you may have recourse to the Lawyers Council of Thailand in respect of our professional conduct.
10. Intellectual Property
All content on this website — including text, layout, design, and marks — is the property of Phueng Counsel or its licensors and is protected by applicable intellectual property laws. You may not copy, adapt, or redistribute any content from this website without our prior written consent.
Written documents produced in the course of an engagement and delivered to the client may be used by the client for the purposes of the engagement. They may not be reproduced or distributed to third parties without our consent.
11. Third-Party Links
Our website may contain links to external websites for your convenience. We are not responsible for the content, accuracy, or practices of those sites. The inclusion of a link does not constitute our endorsement of the linked site.
12. Changes to These Terms
We may update these Terms and Conditions from time to time. Changes take effect when the updated Terms are published on this page, and the "Last Updated" date will be revised accordingly. We encourage you to review these Terms periodically. Continued use of our website after any revision constitutes acceptance of the updated Terms.
Changes to the Terms applicable to an active engagement require the written agreement of both parties.
13. Governing Law
These Terms and any disputes arising from them are governed by the laws of the Kingdom of Thailand. Any dispute that cannot be resolved through our internal complaints process is subject to the jurisdiction of the courts of Thailand.
